Article 1 - Applicability

1. These are the general terms and conditions (“General Terms and Conditions”) of Webbags B.V. (“The Chesterfield Brand”). These General Terms and Conditions apply to all orders placed through the website of The Chesterfield Brand.

2. By placing an order you explicitly agree with the applicability of these General Terms and Conditions to the order placed by you and you declare that you are aware of the contents thereof.

Article 3 - Agreement, Price & Payment

1. The agreement shall be concluded when you place an order through the website and The Chesterfield Brand has sent you a confirmation of your order by email.

2. The Chesterfield Brand reserves the right not to accept your order if:

- The information entered by you is not correct or complete and if The Chesterfield Brand. doubts the correctness of this information;

- You have failed to meet an earlier payment obligation;

- You have failed to accept the delivery of an earlier order and/or you have failed to pick up an earlier order;

- The delivery address indicated by you is in a country where The Chesterfield Brand does not make deliveries.

The Chesterfield Brand shall inform you as soon as possible if it does not accept your order.

3. The price indicated on the website at the moment of payment is a total price of all products, including shipment expenses and taxes applicable in the European Union.

4. To pay for your order, you can choose one of the payment options offered by The Chesterfield Brand.

5. Orders that are delivered outside the European Union may be subject to additional surcharges and/or taxes. These surcharges and/or taxes are expressly not factored into the total price mentioned in paragraph 2 of this article. Additional costs, if any, on the basis of these surcharges and/or taxes shall be for your account and risk.

6. The Chesterfield Brand cannot be held to an offer on its website if you can reasonably understand that the offer, or a part thereof, contains an obvious mistake or writing error, such as an unusually low price. We request you to contact The Chesterfield Brand if you have any doubts about the correctness of an offer.

Article 4 - Delivery

1. The Chesterfield Brand will do its utmost to process and deliver your order as soon as possible after receipt of payment. A term of delivery indicated by The Chesterfield Brand is indicative. The delivery dates indicated on the website of The Chesterfield Brand. are based on circumstances known to The Chesterfield Brand at the time of the conclusion of the agreement and may be subject to changes due to external factors, such as the method of payment chosen, the manner of transport and internal availability. The delivery dates are also subject to change if you make changes to your order.

2. You are obliged to do everything possible that may be reasonably expected of you to enable The Chesterfield Brand to deliver your order on time. If you do not cooperate as described in this Article 4 paragraph 2, The Chesterfield Brand reserves the right to not deliver the products.

3. Your order will be delivered at the delivery address or pick-up point you have indicated on the website of The Chesterfield Brand.

4. The ownership of the products ordered will be passed to you at the time when The Chesterfield Brand has received your payment for the products ordered by you.

5. The Chesterfield Brand will make an effort to deliver the products ordered by you complete and in good condition. In the event that the products delivered are not complete or damaged, we request you to contact us as soon as possible.

Article 5 - Faithful Reproduction & Lifetime

1. The Chesterfield Brand will do its utmost to reproduce the products as faithful as possible on its website. If you are of the opinion that the product ordered by you does not correspond with the reproduction on the website – at the time when the product is ordered – you can use your right of withdrawal. Article 6 of these General Terms and Conditions describes how you can use your right of withdrawal.

2. The lifetime of the products offered by The Chesterfield Brand on its website depends on the product’s material and the way in which and the intensity with which you use the product. In order to ensure that the products will maintain their longest lifetime and highest quality, it is important to observe the instructions on our website.

Article 6 - Cooling-Off Period & Right of Withdrawal

You have the right to cancel this contract within 14 days without giving any reason. The cancellation period will expire after 14 days from the day on which you acquire,or a third party other than the carrier and indicated by you acquires, physical possession of the last good.

decision to cancel this contract by a clear statement (e.g. a letter sent by post, fax or
e-mail). You may use the attached model cancellation form, but it is not obligatory.
To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right of cancel before the cancellation period has expired.

1. If you are not satisfied with your product(s) ordered, you can dissolve the agreement within a cooling-off period of fourteen (14) days after receipt of the product concerned without giving reasons (right of withdrawal).

2. The cooling-off period starts on the day after which you have received the product, or on the day that a third party designated by you (this is not the carrier) has received the product.

3. If you want to use the right of withdrawal, you may also follow the instructions of The Chesterfield Brand which you can consult through the website https://www.chesterfieldbags.com/en/service/shipping-returns/. We want to ask you to return the product or products concerned as soon as possible and to do so in any case within fourteen (14) days after you have informed us that you want to return the products. The product or products concerned can be sent to the address for returning products mentioned in Article 2.

4. After receipt, The Chesterfield Brand will inspect the product or products in order to see whether you are eligible for a refund.

5. If a product is eligible for a refund, The Chesterfield Brand will pay back the amount paid for the product within five (5) days after receipt of the product concerned into the bank account number used by you.

6. We will bear the cost of returning the goods. An exception to this is when the customer returns an order to us on his own without using our return procedure. The costs in this case are always for the customer.

7. Products that we have produced especially for you or that we have adjusted at your request, will not be eligible for a refund and cannot be returned. The same applies to sealed products that, for reasons of health protection or hygiene, are not suitable to be returned and the sealing of which has been broken after delivery.

Article 8 - Complaints Procedure

1. We will do our utmost to have the order and delivery process proceed without problems. If you still have a complaint, you can contact us via our contact details as mentioned in Article 2 of the General Terms and Conditions.

2. We aim to solve your complaint as fast as possible.

Article 9 - Applicable Law & Competent Court

1. These General Terms and Conditions and the agreement(s) concluded between The Chesterfield Brand. and you are subject to Dutch law. The applicability of the United Nations Convention on Contracts for the International Sale of Goods is excluded.

2. The competent court of Groningen has exclusive jurisdiction in the event that a dispute cannot be settled amicably.

Article 10 - Changes to the General Terms and Conditions

1. The Chesterfield Brand. may, at any time, modify these General Terms and Conditions. Changes to the General Terms and Conditions will only be effective if the changed version has been published on the website of The Chesterfield Brand.. We expect you to consult the most recent version of the General Terms and Conditions when purchasing products on the website.

Additional General Terms and Conditions

Article 1 - General terms and conditions for Win Contests The Chesterfield Brand

These General Terms and Conditions of Win Contests of The Chesterfield Brand (hereafter: 'General Terms and Conditions of Win Contests') apply to the win contests on the website of chesterfieldbags.com and the social media channels of @chesterfieldbags. By participating in these win contests, the participant agrees to the General Terms and Conditions of Win Contests below.

The organizer is Makorian bv in Assen.

1. Participation is free of charge without obligation to purchase.

2. By participating, the participant accepts these terms and conditions.

3. You participate in the action if you have responded on @chesterfieldbags social media or, if applicable, you have filled out an entry form.

1. A minimum age of 16 is required to participate in an action; participants under 16 declare to have received permission from (a) parent(s) to participate in the win action.

4. Employees of Makorian bv are excluded from participating in actions.

5. The duration of the action and the moment of announcement of the winner(s) will be mentioned in the post or on the entry form.

6. Makorian bv will not be liable in any way for any damages resulting from the participation in the contest, nor for any technical malfunctions, defects or delays related to the participation in the contest or the designation of the winner.

7. Makorian bv is free to change the conditions of the action or to terminate the action without reason.

8. Personal data of participants will not be disclosed or shared with third parties without consultation, unless permission has been granted.

9. Participants' personal information may be used internally to send The Chesterfield Brand newsletters, if permission has been granted.

10. The winner of a promotion is chosen by an impartial draw.

11. The winner of a promotion will be notified personally through the social media channel on which the promotion took place. If an email address has been left behind, the winner will be notified by email.

12. If the winner does not respond within two weeks of the announcement, a new winner will be chosen.

13. Makorian bv is authorized to disqualify persons who are suspected of illegal participation or fraud.

14. Participants who have not won a prize will not be notified.

15. The prize is not transferable, exchangeable or payable in cash or for other products or services.

16. Dutch law applies to all actions.

17. If one or more provisions of the General Terms and Conditions for Win Promotions are void or invalid, this will not affect the validity of the other provisions of the General Terms and Conditions for Win Promotions.

1.1 - Discount codes and coupons

1.1.1 Discount vouchers (vouchers which are not available for purchase but are distributed as part of advertising campaigns with a certain period of validity) are only valid in the specified online shop during the specified period and can be redeemed only once in the course of an order process.

1.1.2 The value of the goods must be at least as high as the amount of the voucher. For administrative reasons, it is not possible to refund the remaining balance.

1.1.3 Vouchers can only be redeemed before the conclusion of the ordering process. A subsequent settlement is not possible. The credit balance of a voucher will not be paid out in cash and no interest will be paid on it.

1.1.4 Several vouchers cannot be combined with each other.

1.1.5 If the credit balance of a voucher is not sufficient for the order, the difference can be settled with the offered payment options.

These Terms and Conditions Flyer Giveaway are in addition to the General Terms and Conditions of The Chesterfield Brand Giveaways (hereinafter referred to as the "General Giveaway Terms").

1.3.1 The giveaway runs from Thursday, October 26, 2023, while supplies of flyers last;

1.3.2 The offer is valid only on the website www.chesterfieldbags.com;

1.3.3 Participation in the giveaway is free. To participate in the giveaway, a valid email address and valid personal information must be provided (at a minimum: first name, last name, and date of birth);

1.4.2 The prize is made available once, a total of one winner is chosen who wins;
